Terms & Conditions

The following Terms & Conditions of service apply to all products and services provided by Mint Anchor. Please note that upon the approval of any Mint Anchor quotation, you automatically agree to these Terms & Conditions.

 

Quotations and Project kick-off

All quotations are based on the client’s specifications. The client needs to fill out a design requirement worksheet and only once we have all the required information can we commence with project kick-off. If all the information was not included in the original brief or if specifications were to change, we will need to re-quote the client as the work scoping has changed.

If any specifications were to change during the design process Mint Anchor will need to send the client an additional quotation based on the new specifications.

All quotations are valid for 20 days only. If the quotation is not approved within the 20 day period and sent back to Mint Anchor, the quotation will need to be reconfirmed before proceeding.

 

Requirement Worksheet

The client needs to fill out the requirement sheet clearly and to the best of their ability to avoid additional revision rounds. Additional revision rounds needs to be quoted for.


Upfront Deposit

A non-refundable payment of 50% is required to start with the project. Payment needs to be paid within 5 working days of the invoice date. Work will commence as soon as payment has been received.

 

Balance Payment

Once the artwork/website has been approved by the client, the client will be invoiced with the outstanding balance including any additional costs as agreed upon between Mint Anchor and the client. Payment must be made before the final artwork/website is handed over to the client.

 

Payment Options

Payment can be made via Electronic Funds Transfer (EFT).

 

Cancellation

In the event of the cancellation of any project, the initial deposit will serve as a cancellation fee, along with the additional payment of time spent on the project, if it exceeds 50% of the quoted work.

 

Template Website

The client needs to approve the design template before development will take place. Any additional changes to the template that were not discussed in the approved quotation will be subject to an additional quotation. Only minor changes will be made to the theme during the 3 revision rounds. These minor changes include small textual changes or corrections and small adjustments to the arrangement of items on the page. Minor changes do not include any colour scheme changes, theme layout changes, navigation additions, image editing, features etc. All major changes of scope will be identified and will be subject to an additional quotation.

All materials and services available on the template website, and all materials and services provided by or through Mint Anchor are owned by Mint Anchor. The template website can not be moved to a different hosting provider. The website will need to be recreated on a new platform if the client choose to move and will be subject to an additional quotation. Mint Anchor alone has the right to edit or change anything on the template website. 

 

Custom Website

If the client choose to go with a specific theme the client needs to approve the theme before development will take place. Any additional changes to the theme that were not discussed in the approved quotation will be subject to an additional quotation. Only minor changes will be made to the theme during the 3 revision rounds. These minor changes include small textual changes or corrections and small adjustments to the arrangement of items on the page. Minor changes do not include any colour scheme changes, theme layout changes, navigation additions, image editing, features etc. All major changes of scope will be identified and will be subject to an additional quotation.

We use Elegant theme themes for the base of our custom websites. These themes are licenced themes. Mint anchor holds the licence. The licence extends to websites hosted on our server / servers that we manage only and cannot be extended. If you move to a different hosting provider you will need to purchase the theme from Elegant themes.

 

Website

The client needs to have all the required content ready before we can start with the development process.

After approval of the websites we will provide 20 day free email support. After 20 days support will be billed at an hourly rate.

Any changes to the website after approval will need to be quoted.

 

Web Design Compatibility

  • Google Chrome
  • Firefox version 2 up to current full release
  • Apple Safari version 4 up to current full release
  • Internet Explorer version 10 up to current full release

 

Design

There will be 3 revision rounds unless otherwise agreed upon. The client needs to have all the required content ready before we can start with the design process. Mint Anchor will design 2 – 4 concepts for logos and corporate identities. The approved artwork will be supplied to the client. All other artwork remains the property of Mint Anchor unless agreed upon. Designs may not be altered in any way except for size or changed to greyscale.

 

Hosting             

The client will be invoiced annually for hosting, unless otherwise agreed upon. Failure to pay the full amount outstanding within the specified payment terms will result in the removal of the client’s website from the server. A reactivation fee of R400 in addition to the full outstanding amount for hosting will be required before the website is reactivated.

 

Copyright and Trademark

By supplying text, images and any other data to Mint Anchor the client declares that he/she holds the appropriate copyright and/or trademark permissions. Mint Anchor will in no way be held liable for any copyright and/or trademark infringements.

 

Artwork Ownership

Upon project completion, the client will own the approved artwork that was specifically created for the client.

 

Revisions

There will be 3 revision rounds for all projects unless specified otherwise. Revision rounds are a list of small changes required by the client. The client needs to ensure that they go through the artwork/website carefully and that they list the required changes clearly. Additional revision rounds are available on request and at an additional cost.

 

Approval of Final Artwork

While Mint Anchor takes care to avoid errors, we accept no responsibility for typographical errors, spelling mistakes or incorrect information on any product or service supplied. The email verification will be conclusive as to the approval of the artwork. No refunds will be given after final approval has been received.

 

Project Completion

The project is considered complete after the artwork has been approved and the final payment has been received. Any additional services such as printing, production, content upload; publishing etc. that was not specified on the original quotation will be treated as a separate project and will be quoted for separately.

 

Termination of Services due to Non-Payment Clause

Mint Anchor may discontinue services or take down a website if an amount payable to Mint Anchor is overdue for more than 20 days.  The client remains liable for the total cost of the contract. If any invoice(s) remains unpaid, copyright on all work remains with Mint Anchor.

 

Design Credits and Reproduction of Work

The client agrees to allow Mint Anchor to place a small credit on all printed material, advertisements and/or a small link to Mint Anchor’s own website on the client’s website.

The client also agrees that Mint Anchor retains the right to use the completed project for the marketing of Mint Anchor. This may include the client’s website, a link to the client’s website and all designs including any designs done in the preliminary rounds.
